Copyright Law for Documentary Film and Video Production

Ever wondered why “Night of the Living Dead” is in the public domain? Or why Todd Haynes’ Superstar: The Karen Carpenter Story was pulled from distribution? This workshop is designed to offer a broad overview of copyright law as it relates to documentary film and video production. Besides discussing acquisition of literary, visual and music rights, this workshop will address how to avoid potential infringement claims and how to register and protect your copyrights. Special emphasis will be placed obtaining necessary releases, analyzing what constitutes a fair use of copyrighted material, and how to evaluate whether a work resides in the public domain.

Presenter: Alan Korn, Esq. is an arts and entertainment lawyer based in Berkeley, California with a focus on documentaries, music and IP rights issues. Over the last 20+ years Alan has assisted numerous documentary film projects, including the Academy Award-nominated “The Weather Underground,” “The Yes Men,” “Copyright Criminals,” “The Cult of J.T. Leroy,” “Orgasm, Inc.,” “Uranium Drive-In,” “Cowspiracy,” “Going on 13” and “To Chris Marker: An Unsent Letter.” He also appears (as himself) in the documentary “Sonic Outlaws” by Craig Baldwin (1995) addressing the intersection of fair use, free speech and artistic expression.
