The Basics of Special Needs Trust Planning and Administration

Institute on Aging welcomes you to a free, 1.5-hour training at 3575 Geary Blvd., San Francisco, CA 94118. Continuing Education credit will be offered.
This presentation will discuss the basic purpose and utility of special needs trusts (SNTs), with a particular focus on the use of SNTs to preserve public benefits for seniors. Topics covered will include the various types of special needs trusts (first party, third party and pooled special needs trusts) and the key differences between them.
Attention will be given to how these various trusts are established, as well as issues which arise in the administration of SNTs and what happens on the termination of the trust.
Additionally, we will discuss the most common public benefit programs which SNTs seek to protect, paying attention to both the impact which the establishment and funding of a SNT has on eligibility for benefits---as well as concerns regarding the benefits which arise in the administration of SNTs.
Finally, we will touch on alternatives to SNTs, to provide an awareness about when use of a SNT is most beneficial, as well as options available when a SNT may not be the best fit for a particular individual.
By the end of the training, participants will be able to:
- Compare purpose and types of special needs trusts, including at least 3 key differences among the most common types of special needs trusts
- Demonstrate understanding of the public benefit programs most commonly utilized by seniors, which use of a special needs trust serves to protect
- Highlight at least two common issues which arise in the administration of special needs trusts, particularly as the administration relates to public benefits and issues which arise on the termination of a special needs trust
- Provide context for understanding when a special needs trust is an appropriate option for a particular individual
- Describe at least two alternatives to special needs trusts
Presenter Bios:
Trisha Friedeberg is a partner with Kato, Feder and Suzuki, LLP. Ms. Friedeberg concentrates on conservatorships, trust and probate administration and litigation, special needs trusts, long-term care planning and estate planning. She represents professional and non-professional fiduciaries, as well as interested third parties. For many years, Ms. Friedeberg has volunteered with organizations which serve older adults. Ms. Friedeberg is a member of the Bar Association of San Francisco and is on the San Francisco Superior Court panel of attorneys who are appointed to represent proposed conservatees. She received her undergraduate degree from the University of California at Davis and law degree from the University of San Francisco.
Will Doyle is an associate attorney with the law firm of Kato, Feder and Suzuki, LLP, in San Francisco. Will concentrates on special needs and long-term care planning, general estate planning including estate and property tax planning, and trust and probate administration. He represents professional and non-professional fiduciaries, as well as interested third parties. Will started his career at Kato, Feder & Suzuki in 2002, while he was a student at City College of San Francisco.  Since then, Will has worked in multiple facets of the firm in both administrative and legal roles, becoming an associate attorney following graduation from law school in 2015. Will received his bachelor’s degree from the University of California at San Diego and his law degree from Golden Gate University, graduating with Honors and multiple class awards, including a CALI award for excellent achievement in the study of Wills & Trusts. While a student at Golden Gate University, Will concurrently received a Masters of Laws in Taxation and the Academic Excellence Award in Tax Law for 2015, as well as a certificate of completion of evaluated instruction in Mediation and Conflict Resolution.
This training will be appropriate for those in aging services, including: psychologists; family therapists; social workers; nurses; elder-law practitioners; long-term care administrators; gerontologists, human resources professionals and others.
Date: Tuesday, May 7th, 2019, 12:30 p.m. - 2:30 p.m. Doors to the Sequoia Room training will open at noon. The program will begin on time, so please be prompt.

Directions and Parking: Limited street parking around the building, in mostly 2-hour increments. Public transportation is nearby, with the Geary bus running right in front of the building.
This is not a lunch-and-learn. We will not be dining during this training. Water will be provided.
